What Is Erb’s Palsy? What Causes It?

Erb’s palsy is the result of serious damage to the upper section of the brachial plexus, the bundle of nerves in the shoulder. Injury to the brachial plexus is often caused by shoulder dystocia, which is when the child’s shoulder gets stuck during birth. (Usually, it gets stuck behind the mother’s pelvic bone as the child attempts to come through the birth canal.) This can easily stretch or tear the nerves in the shoulder, leading to nerve damage, paralysis, and various palsies.

Shoulder dystocia does not always lead to injury. When it does, medical negligence is often at fault.

Examples of how negligence could lead to Erb’s palsy include when the birth team mishandles shoulder dystocia, such as by:

  • Failing to effectively help an infant along the birth canal
  • Using forceps or vacuum extraction for too long
  • Using forceps and vacuum extraction in the same birth
  • Delaying an emergency C-section
  • Failing to identify shoulder dystocia at all

If you suspect that your OB-GYN or another health care provider on your birth team was negligent, we recommend consulting our Savannah Erb’s palsy lawyers as soon as you can.

Recover Compensation Through an Erb’s Palsy Lawsuit

A civil lawsuit can result in compensation for the damages you incurred due to your child’s Erb’s palsy. This may include compensation for both your and your child’s medical expenses directly related to their diagnosis, such as:

  • NICU stays
  • Extended hospital stay
  • Necessary surgeries
  • Psychological therapies
  • Physical and occupational therapies
  • Accommodations and assistive devices
  • Follow-up and long-term medical care

Compensation may also cover your and your child’s pain and suffering. If you had to take extra time off work to care for your child because of their injury, you may also be entitled to compensation for your lost wages.

At Tate Law Group, LLC, we won’t let the at-fault health care provider continue to get away with the harm they brought you and your family. We have recovered $100 million and counting for our clients. If the at-fault party refuses to take responsibility, we are prepared to take them to court on your behalf. When you are ready to speak to a fearless attorney, one who truly cares about your family, we are right here to take your call.
